These Terms of Service ("Terms") govern your use of the Southport Creative website, client portal, and services. By engaging our services or using our portal, you agree to these Terms.
Southport Creative provides web design, website development, WordPress development, SEO, maintenance, and related digital services. The specific scope, deliverables, and timeline of any project will be defined in a proposal, agreement, or statement of work agreed between us and the client.
Work is performed according to the agreed scope. Requests that fall outside that scope ("scope changes") may require additional time and cost, which we will communicate before proceeding.
To keep your project on schedule, you agree to provide timely content, feedback, approvals, and any materials we request (such as text, images, logos, and access credentials). Project timelines depend on prompt client responses.
Deliverables submitted for approval through the client portal are considered accepted when you approve and electronically sign them, or after a reasonable review period if no revisions are requested. Approval authorizes progression to the next phase of the project.
Reasonable revisions within the agreed scope are included. Extensive changes or revisions beyond the agreed scope may be billed separately.
Upon receipt of full payment, ownership of the final deliverables produced specifically for your project transfers to you, except for any third-party assets, licensed components, or our own pre-existing tools and frameworks, which remain owned by their respective owners. We may display completed work in our portfolio unless otherwise agreed in writing.
Projects may involve third-party platforms (hosting, domains, plugins, payment processors, etc.). Those services are governed by their own terms, and we are not responsible for their availability or performance.
We deliver our services with professional care. However, services are provided "as is," and we do not guarantee specific results such as search rankings, traffic, or revenue, which depend on factors outside our control.
To the fullest extent permitted by law, Southport Creative shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim shall not exceed the amount paid by you for the specific service giving rise to the claim.
Either party may terminate a project with written notice. You remain responsible for payment for all work completed up to the termination date.
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles.
We may update these Terms from time to time. The latest version will always be posted on this page with an updated date.
